Wouldn't this qualify as fair use? The association here is that it's an NFL branded football which is essentially their product and this is a league based around their product. So I'm just using it to emphasize that. It's not like I'm doing something like this with it.
I know just enough intellectual property law to be dangerous. You may be right. However, I can tell you that being right does not always insulate you. It still costs money to prove you are right. For the sake of argument, if you were to receive a "cease and desist" letter would you immediately capitulate or fight it? The NFL is stingy with their brand (I am thinking the whole "Super Bowl" policing they do). While this use would not be the same in that it is not being used by a commercial entity like a bar or something, I think it would be close enough to draw their ire. Just my opinion. Devil's advocate opinion. I think it looks great in and of itself.
It's a logo for a video game league. Of course we would fight it, lol. I do know that they're stingy with their brand and there's only one concern about my argument that I would have regarding that. TSO is a site that collects revenue through ads and through membership fees and this is becoming essentially a TSO sponsored league. So leagues like HK are intended to drive/keep traffic to the site and drive up the revenue. And through that, there is income loosely coming from the NFL logo.
First one kind of sounds like it is the Cowboys of the 90s experience. Don't get me wrong, I am down to play like that. Might level the playing field for me.
